The Conflict between Justice and Value——the Conflict and Balance of Police Encouragement

诱惑侦查一直备受争议。本文从刑事诉讼价值出发,对争议较大的诱惑侦查进行了价值分析,指出了诱惑侦查的效益价值和公正价值此消彼长的矛盾性,并从公正与效益冲突与平衡的角度对诱惑侦查的制度规制提出了建议。

The police encouragement has been controversial all along. This paper, starting from the criminal proceedings value, analyzes the value of the controversial police encouragement, points out the contradictory nature between encouragement value and justice value. And in the view of confliction and balance of justice and value, the paper puts forward some suggestions for encouragement system regulation.
