中小学教师职业培训自由权的现实困境及制度建构

摘要 中小学教师的职业培训现状不理想的原因在于中小学教师职业培训自由权没有得到确立与保障,而中小学教师职业培训自由权是教师专业发展的基本权利诉求。教师职业培训自由权概念来源于第二代人权理论。中小学教师职业培训自由权保障制度的建构,包括经费保障制度,教师参加职业培训的自由选择权的保障制度以及教师岗位流动自由和参加职业培训的登记制度的建立。 Tatus of reality of primary and secondary school teachers' vocational training is not ideal,mainly because the liberty of primary and secondary school teacher's vocational training has not been established,while the liberty is the rights of appeal.The concept of liberty is originated from the second generation of human rights theory,and is an integral part of the liberty of occupation.Its meaning should be included to guarantee funds for vocational training of teachers,freedom of choice and so on.There is no law to formulate the liberty of primary and secondary school teacher's vocational training of specific provisions and it is necessary to perfect the right in the construction of security systems,which includes funding for security system,the security system about the right to teacher's freedom of choice in professional training,freedom of movement of teachers to positions and registration system for vocational training
