近年来随着社会主义法治国家建设的不断推进和高等教育体制改革的不断深入,高等学校与高校学生之间的法律关系也发生了复杂而深刻的变化。这就从客观上要求我们正确识别高等学校与高校学生之间的不同性质的法律关系。从总体上而言,二者间的法律关系是由包括教育宪法关系或者宪法性教育法律关系、教育行政法律关系和教育民事法律关系等在内的一系列常态的、典型的法律关系和仅在特定情况下才会产生的非典型的、非常态的法律关系共同组成的多重结构性的法律关系体系。

With the promotion of socialist country building of ruling by law and the deepening of higher education system reform, the legal relationship between colleges and college students has undertaken complicated and profound changes, which demands us to identify the legal relationship of different nature objectively. In general, the legal relationship between colleges and college students is jointly formed by a series of normal and typical legal relationships including education constitutional relationship or constitution educational relationship, education executive legal relationship and education civil legal relationship and other abnormal and non- typical legal relationships existing in certain special conditions.
