中国法学的边缘化发展

The marginalized development of science of law in China

法哲学是从一定的哲学世界观和方法论来观察和认识法这一社会现象的学科。目前越来越多的学者倾向于从边缘角度来看待法律现象。中国法学的边缘化即是中国法学走向沿边的部分或走向靠近边界线区域的一种发展趋势——即由中心走向边缘。对这一趋势,可从法的概念、法学研究方法和纠纷解决方式这三个角度做出阐释。

Law philosophy is a subject which observes and realizes law from the perspective of philosophic world view and methodology. At present more and more scholars tend to consider the legal phenomenon from the perspective of margin. The marginalization of science of law in China means that science of law in China tends to develop toward marginalization, that is, from center to margin. This may be explained from the concept of law, research method of science of law and dispute settlement way.
