关于我国公益诉讼的思考

China's Public Welfare Lawsuits in Consideration

面对公益损害如何寻求司法救济,这是我国法律实践中面临的一个新课题。在我国,相关的公益诉讼制度尚未建立,但在社会实践中已出现了大量的公益诉讼案例,并对我国公益诉讼制度的构建提出了客观要求。文章从"公益诉讼"在我国的发展现状及构建我国公益诉讼制度的必要性、可行性等方面进行了阐述,并提出了解决的对策。

Public welfare damange for judicatory relief has become one of the major problems of law execution in China, where relevant public welfare lawsuit systems have yet to be extablished while in social practice are already a lot of such welfare lawsuit cases, which demand the extablishment of such welfare lawsuts systems in return. This article, based on China＇s developmental situations and the necessity and feasibility of China＇s public welfare lawsuit systems, attempts to expound comprehensively for the proposal of strategies for solution of such issues.
