The Protection of Land-use Rights in Urban House Demolition

在城市化推进的过程中,全国各地发生了大规模的征地和拆迁,引起了许多的法律纠纷案件,处理不好甚至可能成为大规模群体性事件的导火索。在这些拆迁纠纷的背后,是政府、拆迁人和被拆迁人之间错综复杂的利益纠纷。本文针对法律层面和现实层面对土地使用权的忽视,提出土地使用权作为公民合法享有的财产权利,也是与房屋所有权有区别的权利,对其补偿有必要性和合理性。并且针对我国现行法律中对土地使用权补偿规定的不合理的地方,提出一定的建议。

In the process of Urbanization, land requisition and house removing occurred in large scale, which aroused many legal disputes. Once handled inappropriately, these could be the primacord of mass participation disputes. Behind the conflicts involved in the removing is the conflict of interest among the government and the interested party of compulsory demolition. This essay focuses on the ignorance of usufruct of land in the prospect of law and the reality, and proposes that usufruct of land, as an legitimate property right of citizens and one that is different from the housing ownership, should be compensated. The author then points against the improper regulations in the present law about the compensation of land usufruct and makes some suggestions.
