本文考察了水土保持领域"水土流失治理费"制度的法律渊源、法律依据的合理性与正当性,分析了该制度在地方立法和实践中存在的种种问题,论证了在立法上完善该制度的迫切性和必要性,并提出了对策性建议。

This paper reviews sources of law concerned, the rationality and legitimacy of related law on the system of ＂soil erosion control fee＂ in the field of soil and water conservation, analyzes various problems of the system existing in the local legislation and practice, and demonstrates the urgency and necessity of improving the system in the area of legislation. And at last this paper proposes some countermeasures recommendations.
