With the extensive application of search engine technology, implied license research has gradually be- come a practice in the field of web search services. The implied license of network search services is ＂the order of spontaneous＂. There are different opinions about the legal status of the implied license. Based on the realistic con- dition and the future trend, to improve the system designing is helpful to ease the tension between the copyright owner and the network service provider, thus correctly guiding the application of the system. The implied license should be established in network search services to remove the legal barriers for the improvement of search technology.
