摘要
绿色金融政策是"两型社会"建设中可资利用的一种市场激励机制,它包括绿色信贷、绿色证券与绿色保险等制度。我国已初步建立了绿色金融制度的基本框架,但在规则内容上还有完善的空间。绿色金融政策法律化的可能路径,是在"两型社会"试验区内把它从环境经济政策转化为"绿色金融促进条例",其法律化的正当性基础是"两型社会"的"先行先试权"和"先行先试"立法模式。
Green Finance Policy is a kind of market incentive mechanisms available in the process of building Two-Oriented Society, including Green Credit, Green Insurance, Green Security and so on. The existing Green Finance system has been established the basic framework, but betterment is needed. The possible routine of the Legislation of Green Finance Policy is to trans- form it to ＂Green Finance Promotion Rule＂ from an economic policy in the pilot area of Two-Ori- ented Society. The legitimacy base is subject to the legislation pattern of ＂First Trial＂ and ＂Right of First Trial＂ of Two-Oriented Society.
