摘要
随着全球和国内经济形势的变化,中国房地产业的发展也呈现出上下波动的特征,在其诸多影响因素当中,各界关于政府在该领域是否应该行使以及如何行使宏观调控权的讨论一直都未有停歇,而且大有愈演愈烈之势。在市场经济和我国现行政策、法律体制条件下,政府在某种意义上欠缺作为房地产市场调控主体的正当合理性,即使市场出现失灵使行政干预经济成为必要,也应当遵循法定正当程序展开。
With the change of global and domestic economic situation, the development of Chinese real estate market is up and down as well. Among the influencing factors, governmental behavior of macroeconomic regulation and control has been under arguing. Under the current political and legal structures, the validity of such governmental behavior should be absent, moreover, it should comply with the market rules and abide by laws when necessary.
