摘要
《婚姻法》第46条所规定离婚损害赔偿,本质是离异损害赔偿,即离婚时配偶一方对无过错的配偶另一方因离婚这一身份契约的解除所引起的财产损害与精神损害的赔偿。因而在配偶一方因侵权行为给另一方造成损害时,受害人在提出离婚时,仍然可以依据《民法通则》第106条第2款以及相关司法解释,请求加害人承担侵权损害赔偿责任。为了更好的保护婚姻关系中无过错一方配偶的权利,在离婚损害赔偿制度之外,应该确立夫妻之间侵权的婚内损害赔偿。在构建婚内损害赔偿制度时,可以增设非常法定夫妻财产制作为基础。
The divorce damage compensation stipulated in Article 46 of ＂ The Marriage Law＂ , in essence, is the compensation for property damage and moral damage caused for dissolution of marriage to the innocent spouse . Therefore, if one of the spouses causes damage to the other for infringement, when the victim asks for a divorce, he/she can still request the perpetrator to undertake the tort liability for damages based on paragraph 2 Article 106 of ＂The Civil Law＂, and related judicial interpretations. In order to protect the marriage rights of the innocent party, it should be established the marital infringement damage system besides the system of divorce compensation. In the construction of the marital infringement damage system, additional marital property system can be produced as the base.
