Local Administrative Legislative Power Regulated by Law Reservation Principle in Lanzhou Highway and Bridge Charges

以《兰州市贷款建设路桥车辆通行费征收管理办法》是否与法律保留原则冲突为例进行分析论证,探讨了该原则对地方行政立法权规制的重要性,并对如何有效防止行政立法权的滥用做了探讨。

Law reservation principle sets substantially a limit to the legislative right and administrative power, therefore, decides the scope of the administrative regulation. It stresses the basic requirement of legal empowerment to the administrative institutions. It has limited guidance or impact on Chinese administrative legal practice or on the local administrative legislative power due to an insufficient understanding of the basic principle or its regulation scope. Based on an investigative analysis of any possible conflicts between the principle and Lanzhou Charge Regulation of Loan-Built Highways and Bridges （hereinafter ＂Regulation＂） the paper tends to explore the important regulation of the law reservation principle in the local administrative legislative power and then discuss some efficient supervision of administrative legislation abuses.
