A Research of Administrative Compensation Procedure Reform

行政赔偿程序是对赔偿义务机关行使公权力的有效约束,是对赔偿申请人合法权益的一种有效保障,符合科学发展观以人为本的思想,是构建和谐社会,有效化解社会矛盾的制度保障。通过对法律程序、行政赔偿程序等基本概念的分析,并借鉴各国行政赔偿程序立法的先进经验,提出了进一步完善我国行政赔偿程序的立法建议。

Administrative compensation procedure, an important element of national compensation system, is an indispensable requirement for the national compensation realization, which is not only an effective control of the public right taken by the administrative enforcement organs, but also an efficient guarantee of beneficiaries＇ legal right. In accord with the people-oriented scientific development view it is a systematic guarantee to construct a harmonious society and effectively dissolve social conflicts. Through analyzing the basic concept of legal procedure and administrative compensation procedure and learning advanced experience of compensation legislature form other countries the paper puts forward some legislative suggestions for the improvement of Chinese administrative compensation procedure.
