论我国行政程序法的立法动因、结构与准则

On Legislative Motivation,Conformation and Principles of the Administrative Procedural Law in China

针对我国行政程序法缺失的现实情况,本文对制定行政程序法的立法动因、立法结构以及立法内容所遵循的基本原则进行了分析并提出了自己的看法,以期为制定一部适合我国国情的完备的行政程序法提供参考。

Due to the reality of legal deficiencies, it is very important for China to formulate the Administrative Procedural Law. This paper demonstrates the legislative motivation, conformation and principles to formulate a complete Administrative Procedural Law in accordance with Chinese real situation. The author hopes to provide with some references and advices for the current legislative process.
