摘要
研究司法与民主问题,首先必须厘清司法与民主的内涵及其关联。而司法与民主理论关系的铺垫,可以为实务研究奠定坚实的基础和框架。司法运作过程中的法官选举制度,极大地显现出司法制度的民主特性。围绕法官直接选举和间接选举制度,通过对这两种法官选举模式的民主性作了较为深入的研究,进而对中国特色的法官双重民主选举方式进行探讨。
It is important to analyze the connotation and relationship of justice and democracy,when studying the matter of Justice and Democracy.And this may lay the solid foundation and framer for the practice research.The system of judicial election appears enormously democratic characteristic in judicial operation process.Based on the direct and indirect judge election system,the author further studies the democratic nature of this two judge election system,and discusses the Chinese characteristic＇s dual democratic election of judge.
