The Triple Realms of Harmony World Ideas in Private International Law

和谐世界理念的基本价值指向是平等、公正、多元。和谐世界理念与国际私法存在紧密的互动关系。国际私法追求和谐的第一重境界是力求实现各国法律体系的平等共存。国际私法追求和谐的第二重境界是实现对不同国家当事人的公正保护。这两重境界的和谐诉求由于国际社会现实和调整方式的局限难以实现。现代国际私法追求和谐的第三重境界是对传统国际私法的价值目标和调整方法进行融合,以求实现更高境界的和谐,即对当事人的正当利益的有序调整。

The basic value of the idea of harmony world is equality, justice and diversity. There is close relations between the idea of harmony world and private international law. The first level of harmony, which PIL seek, is the equal co-existence of different legal systems. And the second level of harmony is the equal protection of persons from different country, these two levels of harmony is difficult to realize. In order to realize higher level of harmony, the third level of harmony that modern PIL pursues is the integration of different values and different methods of regulation. That is to realize the orderly regulating of the proper profits of individuals.
