摘要
宅基地使用权的社会保障功能阻碍了它的转让,但用益物权的属性又构成了其实现转让的基础。在兼顾公平效率的价值取向下,宅基地使用权的社会保障性和用益物权性可以实现兼容。建议立法在规定宅基地使用权原始取得无偿性和存续有期性的前提下,对宅基地使用权的内部转让和外部转让、单独转让和随房转让等予以确认。
The social security function of the use right to Chinese farmers'housing land has hindered its transfer,but its characteristic of usufruct makes its transfer possible. Under the principle of paying attention to both fairness and efficiency value,the use right to farmers'housing land may realize its security function and usufruct nature simultaneously.It is suggested that the different transfer of the use right to farmers'housing land should be stipulated on the basis of free use and limited period.
