An analysis of the review of RTAs under WTO

以RTAs的审查现状、审查要件和审查路径为主线,剖析了基于GATT第24条、GATS第5条和"授权条款"的审查要件,阐释了外交审查和司法审查路径,并指出虽然司法审查的实践使RTAs审查取得了实质性的进展,但规则的澄清和完善、外交审查与司法审查关系的协调以及审查效力等问题尚待解决。

The multilateralism ranging from GATT to WTO has had to bear a heavy cross, ie, the Regional Trade Agreements （RTAs）. When there is no evidence to show that the cross is to be dismantled, the improvement of the RTAs review becomes practically neeessary. Through an analysis of the status quo, requirements, and paths of the review of RTAs, this article suggests that under GATT/WTO, in spite of the substantial advance, such prob- lems as the interpretation of the relevant provisions, the review efficiency, and the cooperation of the WTO members need to be solved.
