摘要
修订后的《专利法》对外观设计提供了许诺销售保护。本文在法学理论分析基础上探讨了许诺销售侵权构成,根据外观设计创造性成果地位论证了保护设计要点的必要性,为外观设计划定了适当的保护范围。并对两类许诺销售侵权提出了判断标准。
The revised "Patent Law" provides the promise sales protection for appearance design. This paper, based on the theoretical analysis of Law discussed the composition of infringing of the promise sales, according to the status of the creativity of design demonstrated the need for the protection of design features, provieded an appropriate delineation for the scope of protection, and proposed criteria for judging two types of infringing.
