论法官的角色定位

On the Positioning of the Role of Judges

前不久在昆明发生的法官拷律师的案件,曾引起社会舆论的广泛关注与热议。笔者认为如果法官不能准确地把握自己在审判中的角色定位的话,类似事件就还会重演。那么,法官应有怎样的品行和修养?法官对自己的角色应怎样定位?法官应有怎样的法律信仰?这些问题正是笔者在本文要重点讨论的问题。

A recent case of the lawyer hand- cuffed by the judge took place in Kunming has attracted widespread media attention and heated debate. The author believe that if the judge can not accurately grasp their position of the role in the trial, similar incidents will be repeated. So, what morality or cultivation the judge should have？ How should the judge position their role？ What kind of legal belief should the judge have？ These problems should be discussed in this article.
