Legal Assessment of the Theoretical Conceptions of Computer and Cyber Crime

网络技术的发展在改变人们生活的同时,也使计算机、网络犯罪更加引人注目。通过对国外和国内学者关于计算机与网络犯罪概念的介绍和对比分析,指出在当前的社会环境下,区分计算机犯罪与网络犯罪已经不具备典型意义,认为关于计算机、网络犯罪的概念也应该而且也有必要是统一的、一脉相承的。

As the development of network technology changes people＇ s lives, it also pushes computers and cyher-crime to the focus of attention. Description and contrastive analysis of the concepts of computer and cyber crimes defined by scholars at home and abroad reveal that, under the current social environment, the distinction between computer crime and cyber-crime is no longer typical. Based on this analysis, this article holds that con- cepts of the computer crime and cyber crime should be unified.
