摘要
现代工程在为大多数人的生活提供更多便利的同时,也给一部分人的利益带来损害。本文将工程活动引起的利益损害性影响分为五种类型并予以讨论,即:持续影响与暂时影响、显性影响与隐性影响、直接影响与间接影响、可避免影响与不可避免影响、可修复影响与不可修复影响。作者分析了工程活动主体与损害的逻辑关系,力陈不能以部分人的利益牺牲,换取另一部分人的利益获得的观点,以期为工程利益损害责任的确定提供分析基础。
China＇s economy is now in the stage of rapid development, especially infrastructure construction. We can say, China now is a truly great engineering country. However, modern projects offer much more convenience for the majority, they also bring damage to the interests of some other people. This paper discusses five types of damage caused by engineering activities,namely, continuing and temporary influences, conspicuous and inconspicuous influences, direct and indirect influences, avoidable and unavoidable influences, recoverable and unrecoverable influences. The author analyzes the logical relation between active agent and damages and states that that we should not protect some people＇ profits by sacrificing other people＇ profits. This provides an empirical and analytical basis for defining the engineering liabilities for interests-damaged party.
