住房权实现中国家平等对待义务的客观性——兼论经济适用房和廉租房政策的合理性

Objectivity of State Equal Treatment Duty in the Realization of Housing Right——Also on the Rationality of Affordable Housing and Low-cost Housing Policy

作为一项社会经济权利,住房权的国家义务较具弹性,但这并不意味着政府的住房保障政策不必遵守任何法律上的规范标准。在住房权实现过程中,国家具有平等对待每一个公民的义务,只有在充分考虑未从住房优惠政策中获益的群体的利益的基础上,以尊重利益受到不利影响的公民的平等权为前提,将比例原则作为客观的检验标准,国家的住房保障政策才具有合法性的根基。而在时下热议的经济适用房和廉租房政策中,更能看出住房权国家义务的客观标准所具有的实际功能。只有符合客观检验标准的住房保障政策才能与基本权利体系相协调,与和谐法治社会的发展相一致。

As a social and economic right, the state duty of housing right is flexible, but it does not mean that the housing insurance policy of government need not abide by any legal norm. In the realization process of housing right, state is responsible for the equal treatment of each citizen. The housing insurance policy is legally based on a thorough consideration of the interest of those who do not benefit from housing favorable policy, and a respect for those whose equal right is unfavorably influenced. A proportional principle is the objective standard. In the currently heated discussion of Affordable Housing and Low-cost Housing Policy, the practical function of the objective standard of state duty of housing right can be perceived. Only a policy enduring through objective test can be coordinated with basic system of right and the development of a harmonious society of rule-by-law.
