摘要
根本违约的二重功能"护权"与"限权"是"自治"与"管制"辩证统一的必然结果,二者相辅相成,不可缺失。"管制"一方面保证"自治";另一方面,为维护第三人利益和公共利益,也会限制"自治"。发生根本违约时,"管制"在一定条件下限制与事人的"自治"的同时,也为当事人更好的"自治"搭建了平台。
Fundamental breach of contract has become an important system in the modem contract law. With perspective of ＂autonomy＂ and ＂control＂, this essay will explore two functions of fundamental breach of contract because of the breeding of the change thoughts of right between individual - based to community- based as well as the dialectical unity between them to improve our system of fundamental breach of contract.
