目前我国以至世界范围内所出现的社会考试的普遍发展应当在一个较为宏观的视野中来进行认识,在某种程度上其可以说是全球性风险社会发展的需要。针对这样的情况,对其所进行的合理规制的设计就应当考虑到法律和教育系统本身的系统特殊性来进行结构性的耦合,这种耦合可以借助于法律系统内的相关知识产权制度予以实现。

At present, the social examination, which is emerging generally in our country and even in the whole world, should be considered under a relatively wider perspective. To some extent, it is formed due to the requirement of the worldwide risking society development. Under this situation, being related to the characters of the law system and the education system, the reasonable regulation on it should be created through the structural coupling between these two systems, which can be fulfilled with the help of the intelligent property institution.
