摘要
鉴于英语立法文本中的定义频繁招致语言和法律专家们的批评,从立法定义与词典定义的区别、立法定义与语义的不确定性、立法定义与法律虚幻三个方面重新解读了英语法律文本中定义的使用,认为有必要对英语立法文本中定义的位置或措辞进行更改。
In the light of frequent criticism on definition in English legislative text, this paper re -reads the application of definition in English legislative text from the three perspectives： the difference between statutory definition and lexical definition, statutory definition and semantic indeterminacy and statutory definition and legal fiction. This paper also reckons that it is necessary to make alteration to the positions or words of the definition in English legislative text.
