俄罗斯反垄断法规制行政垄断之借鉴

Experiences Drawn from the Regulation of Administrative Monopoly by Russian Antimonopoly Law

行政垄断是转型国家市场中的共性问题。俄罗斯反垄断法对行政垄断的规制在行为主体、范围、运行方式、制度效果等方面特性鲜明。分析这些问题可以较全面地认识行政垄断的特殊性及规制行政垄断的特殊性,更可为完善我国《反垄断法》提供经验借鉴。

Administrative monopoly is a common problem faced by the market in transitional countries. In regulating administrative monopoly, Russian Antimonopo tinctive character in terms of subject of act, scope, mode of operation and Law presents a disinstitutional effectivehess. Analyzing them may help us gain a relatively comprehensive understanding of the particulari- ty of administrative monopoly and specific characteristics of the regulation over it. We can draw the successful experiences of regulation of administrative monopoly by Russian Antimonopoly Law so to improve Chinese Antimonopoly Law.
