摘要
随着全国首例住宅续期问题的出现,住宅建设用地使用权期满如何续期引起很大的争论,成为急需解决的问题。根据相关法律法规的规定,讨论了住宅用地的规定年限少于法定最高年限和住宅用地的规定年限为70年的两种情况下的住宅建设用地使用权期满续期问题,主要观点是无偿自动续期。同时,谈及非住宅建设用地使用权期满应该有偿续期。
With the emergence of the country's first case of housing problems, how to renew the housing land-use right expired has aroused a lot of controversy, necessitating an urgent solution. Based on the relevant laws and regulations, this paper discusses the renewal issue of the expired housing land-use right in the following two cases: the provisions of residential land less than the statutory maximum number of years and years of provision of residential land for 70 years, the main point being automatically free of charge renewal. At the same time, the expired land -use right of non -residential construction should be paid for renewal.
