浅议管制刀具管理法律文件存在的问题及对策

On the Problems and Solutions of Legal Documents of Controlled Knives Management

目前各级公安机关虽然加大了对管制刀具的收缴力度,却不能从源头上对管制刀具进行控制,甚至在管理上舍本逐末,这与当前管制刀具管理相关法律文件存在着极大的缺陷有直接的关系。管制刀具管理的主要法律依据是1983年公安部制定的《对部分刀具实行管制的暂行规定》,该规定已经极不适应当今的社会条件和法律环境,严重制约着公安机关管制刀具管理的效率。应分析目前涉及管制刀具管理的相关法律文件存在的问题,提出相应的对策。

At present, the public security departments have strengthened the capture of controlled knives, but can＇t control the eontrolled knives from the fountainhead, and effect rely manage, which is direetly connected with the great defect that controlled knives-related management legal documents bare. The main legal basis of managing eontrolled knives is The Provisional Regulation of Controlling Some Knives made by Ministry of Public Security in 1983, whih does not extremely apply in current social conditions and legal circumstance, and seriously limits the efficiency of managing cnntrolled knives. So we should analyze the problems which the current legal documents related to controlled knives have and the limit to controlled knives management, and give corresponding solutions.
