高校公权力规制——信息公开的视角

高校公权力异化现象频发的一个重要原因是信息公开制度的缺失。种种事实表明,屏蔽信息会直接引发道德风险并极易导致高校公权力寻租。所以,公开信息对于规范高校公权力的行使具有重要意义。在高校权力规制的视阈中,分析高校信息公开的基本原则、基本要求、基本形式、监督保障等对于相应的法律制度建设有一定参考价值。

One of the roots of frequent public power alienation of university is the lack of legal system of information disclosure. The facts have proved that the information screen of school running will directly induce the moral risk and easily lead to rent-seeking of university＇s public power. Therefore, the information disclosure of running school has an important value for regulating university＇s public power. In the visual threshold of power regulation, the basic principles, requirements, forms, supervision and safeguard of universities＇ information disclosure have certain reference value for the correspondent legal system construction.
