论当前危机的性质、根源和经济法对策

Characteristics & Source on Present Crisis and the Strategy in Economic Laws

当前的危机既是国际金融危机,又是国际经济危机;只承认当前的危机是国际金融危机而否认它是国际经济危机,是不符合实际的。这次危机的产生固然有多种原因,但其根源是资本主义基本矛盾,即生产社会化同生产资料资本主义私有制之间的矛盾。当前危机的经济法对策,在我国,主要包括依法加强对社会主义公共财产的管理和保护,依法完善计划调控、财政调控、金融调控和金融监管,以及依法加强反对垄断和反对不正当竞争。

Present crisis is not only the international financial crisis,but also the international economic crisis.It is not a correct viewpoint that the present crisis is just the international financial crisis but not the international economic crisis. There are many reasons for the cause of the crisis,but its root cause is based on the conflict of capitalism,that means the conflict between the socialization of production and the capitalistic private ownership of property in production means. At the present time,strategy in economic laws to cope with the crisis should reinforce the management and protection of socialist public property by operation of laws,perfect planned control,financial control ,financial regulation and supervision according to the laws and also reinforce antimonopoly and unfair competition.
