台湾地区“民法”物权编关于“共有”部分之修正简析

The Analysis on the Amendments of Coownership in the Property Chapter of Taiwan Civil Code

台湾地区"民法"物权编之最新修正内容于2009年7月23日正式施行。此次修法关于"共有"部分之修正要点如下:其一,修正分别共有物之管理方法;其二,明定分别共有物订有禁止分割期限之例外规定;其三,增订法院裁判分割之起诉原因、分割方法、效力及共有物之应有部分有抵押权或质权之分割方法;其四,增订分别共有物使用、管理、分割或禁止分割之约定或依法所为之决定或法院所为之裁定,对于应有部分受让人或取得物权者之效力规定;其五,修正公同共有成立之依据及准用规定。

The contents of the latest amendments of property chapter of Taiwan Civil Code have been put in force on 23rd,July 2009. The amendment points regarding coownership are as follows：firstly,amending the managing method of tenancy in common; secondly,stipulating the exceptions of prohibiting time of the separations of common property; third,prescribing the causation of dividing by courts,dividing method,dividing effects,and dividing method of the parts under controlled by mortgage and pledge; fourth,adding to the regulations on the effects of the agreements of coowners or the decisions of court regarding the use,management,dividends,or dividends prohibited; amending the regulations on establishing foundations of common in entirety.
