摘要
法律评估指标的构建应该首先确定评估主体、评估定位、价值取向和评估标准等基本问题,这是构建《高等教育法》评估指标体系的理论前提,但不能忽视高等教育法自身的特点。需要遵循明确性、相关性、全面性、系统性和层次性等原则,在规范性标准、影响力标准、社会公平标准、效率标准、效益标准和效应标准等基础之上来型构《高等教育法》实施效果的评估指标体系。
The establishment of legal assessment index should make clear the subject of evaluation,location of evaluation,value orientation and evaluative criteria firstly. That is also the theoretical prerequisite to establish the carryout effect of "Higher Education Law". Meanwhile the establishment of evaluation index of the carryout effect of "Higher Education Law" should be not only follow the common theories or principles of legal assessment,which makes it placed the model of legal assessment,but also attach importance to the characteristic of Higher Education Law. Then the evaluation index system of Higher Education Law should be established on base of some criteria,such as normative criteria,influence force criteria,justice of society criteria,efficiency criteria,benefit criteria and effect criteria,which also follows some principles,such as definitude,relativity,all sidedness,systematicness and hierarchy,etc.
