摘要
"法律面前人人平等"到底包不包括立法平等?"立法平等论"与"司法平等论"的争议一直存在,至今在法学界仍然没有达成共识。文章试图从正面回答马克思主义法学关于法律的阶级性与"立法平等论"的冲突问题,为立法平等论寻找理论支撑,并对立法平等中不可忽视的差别对待问题进行论述。
Did the meaning of the principle that＂ anyone is equal in front of law＂ include the equality of legislation？ The controversy of ＂Equality of Legislation＂ and ＂Equality of Justice＂ has always been existed and there is still no consensus reached so far. I try to find answer from Marxist theory on the class nature of law.
