Principle of strict liability and environment crimes in PRC criminal law

针对中国环境犯罪归责原则的选择问题,运用比较的方法,探讨英美刑法中严格责任原则能否适用于中国刑法所规定的环境犯罪领域,提出在中国环境犯罪领域应当区分语境,对严格责任原则有选择地加以借鉴。

According to the problem of the criterion of liability in the area of environment crimes in PRC criminal law, the paper focused on whether the principle of strict liability in Anglo- American criminal law may be applied in the environment crimes prescribed in PRC criminal law. By comparing the two different legal systems, it concludes that the suitable method is to adopt the principle selectively but in a Chinese legal perspective.
