浅谈复代理

对复代理的概念和特征进行分析,介绍我国相关法规中的复代理规定并指出其存在的不足之处,并借鉴国外先进立法经验,从允许法定代理人可委托复代理人、增加代理人对复代理人选任的监督义务、变更构成复代理人的主观要件以及规定紧急情况下代理人选任复代理人等方面对我国的复代理制度提出相关的改进建议。

This article analyze the concept and characteristics of from the transferred agency,and then to introduced China＇ s relevant laws and regulations about the transferred agency and pointed out it inadequacies. Finally, draw on advanced foreign legislative experience and from the legal representative may entrust the transferred agent;increase of the supervisory obligation of the agent re - elected the transferred agent;change the subjective element constitutes a transferred agent and require agents entrust the transferred agen in an emergency, to put forward relevant recommendations to improve transferred agency system of China.
