劳动教养制度在我国实施50多年来,权力分配及运行中暴露出了诸如立法权被滥用、行政权过度扩张、司法权被侵占等诸多问题,在中国走向法治国家的今天,权力制约、人权保障等观念日益深入人心,劳动教养制度要适应新的时代发展要求,就必须改革创新。其中,如何分配权力,使国家权力能更好的运行和公民权利更好的得到保障,是完善劳教制度首先要面对的问题。

The Reeducation-through-labour System had already implemented in our country for more than 50 years,there are many problems in the division of powers and the movement.Today,chinese is going to a country under the rule of law,the reeducation-through-labour want to adapt to new requirements for the development,it must reform and innovation.The first question for the innovation of he Reeducation-through-labour System is how to distribute the power to enable the state power a better movement and the rights of citizens better to obtain the safeguard.
