摘要
物业费请求权是物业服务企业基于物业服务合同而对业主享有的合同债权请求权。物业服务合同的当事人是业主和物业服务企业,物业使用人和继受人原则上不能作为物业费请求权的相对人。书面催交物业费是物业服务企业向人民法院提起诉讼的前置程序。业主可以主张违约或违规收费、物业服务存在瑕疵、物业服务合同关系已经终止和诉讼时效经过的抗辩对抗物业服务企业支付物业费的请求。我国立法上对物业费请求权不能实现时的救济不足,应适当加重责任,丰富责任类型。
The claim of property industry fee is a right of obligatory claim , which the estate service company has. The parties of estate service contract are the owner and estate service company. In principle, real estate users and succeeding people are not the counterparts of the claim of property industry fee. Urging property industry fee in written is procedural prerequisite of estate service company filing lawsuits to the courts. Real estate users can put forward some plea instance,such as, estate service company breaking contract , estate service flaw,contract termination. We should weight the liabilities and enrich liability types to remedy the claim of property industry fee.
