论归侨身份确认和安置法律制度的现状与发展

On the Actuality and Development of Legal System of Status Recognition and the Resettling of Returned Overseas Chinese

确认归侨身份是侨务法律制度中的一个重要问题,也是对其进行安置和保护其权益的基础和起点。归侨能否融入国内主流社会是检验归侨安置政策的最重要标准,以此标准衡量,我国过去60年来的归侨安置政策不完全成功。现行归侨安置法律存在着归侨身份确认不严谨、安置内容不明确、社会保障范围窄、忽视融入的重要地位和核心作用等问题。因而有必要积极探索建立公民居留期制度,实现公民动态管理,完善确认归侨身份的法规规章,明确"促进融合"新对待归侨方针,免费提供强迫性和自愿性融合课程,澄清现行法律归侨安置方面的歧义性规定,进而完善归侨身份确认和安置法律制度。

Recognizing the status of returned overseas Chinese is one of the important issues of overseas Chinese legal system, as well the foundation and starting points of protecting one＇ s rights and interests. To integrate into mainstream is the foremost criteria of verifying the policy of resettling returned overseas Chinese. In line with this criteria, Chinese policy of resettling returned overseas Chinese over last sixty years is not very successful. The main issues of current laws of resettling returned overseas Chinese are less rigorous returned overseas Chinese recognition, unclear resettling measures, narrow social security for returned overseas Chinese, ignorance of the important position and key function of integration. It is essential to establish citizens residence period system to flexible manage the mobility of citizens, improve the laws regarding recognizing returned overseas Chinese status, specify the new policy of enhancing integration for returned overseas Chinese, provide the compulsory and voluntary integration courses, and clarify the resetting measures.
