On the Rational Sources of Legal Thinking-on the Formality of Legal Reasoning

从宏观角度论述法律推理的一般理论,通过对推理性质、特点的分析,阐明推理之所以能够根据前提推出结论是因为存在一个实质依据或者形式依据,通过对法律推理的形式和实质的分析,得出在我国法治尚不发达,普遍缺乏对法律的忠诚和信仰的情境下,法律推理应优先适用形式推理而非实质推理的结论。

By analyzing the qualities and features of reasoning, this paper discusses the general theory of legal reasoning from macro perspective and clarifies that the reason why the conclusion of reasoning can be derived from premises lies in that there exists a substantial or formal basis. After studying the form and nature of legal reasoning, it concludes that, in the context of undeveloped nomocracy and in the situation generally lacking faith and belief in law, formal reasoning, rather than substantial reasoning, should be applied to legal reasoning in China.
