立法解释与法官解释关系探析

Legislative Interpretation and Judges' Interpretation

我国正式法所规定的法律解释只包括立法解释和具体应用解释两种,其实质都为广义的立法解释,这显然与法学方法论研究者所讨论的法律解释即法官解释大相径庭。尽管立法解释与法官解释在涵义、性质、解释主体、对象和目的等方面存在诸多差异,但两者各有其独立的存在价值,并且二者在司法过程中可以实现衔接与合作。此外,立法语言的准确性以及立法解释调整范围的广泛性等也都证明,法官解释无法取代立法解释的地位。

Legal interpretation in our official laws only contains legislative interpretation and actual applied interpretation,which are legislative interpretation generally in fact.It is different from the legal interpretation that scholars study with methods of jurisprudence.Although legislative interpretation is different with judges＇ interpretation in many ways,such as meanings,characteristic,subject of interpretation,objects and purpose,etc,they have the self-existent value independently and also cooperate in judicial process.In addition,the veracity of legislative language and the universality legislative interpretation all prove that judges＇ interpretation can not replace legislative interpretation.
