多中心治理理论视野下的大学章程研究

University Statute in the Perspective of Polycentric Governance

作为大学治理的基石,大学章程存在着法律地位不明确、成员权利不明晰、程序性条款缺失、忽视绩效等问题。本文以多中心治理的核心概念分权、权利、问责和绩效为分析框架,借鉴国外制定大学章程经验,提出我国大学章程应具备的内容,为我国大学章程制度完善提供理论指导。

A statute of university is as important as a cornerstone. Uncertainty legal status of the statute, unclear right of the school members, lacking of procedural contents and overlooking performance of the organization are the main problems existed in the Chinese public universities ＇ statutes. Using the four core conceptions of polycentric governance theory as decentralization, right, accountability and performance, to build a framework, and drawing lessons form experiences of oversee statutes of universities, this paper give some useful advices to solve those problems mentioned above.
