在我国立法实践中普遍存在着这样一种现象:甫一制定出的法律就遭到质疑甚至普遍的批评。这不禁让人思考,难道立法者对这些不足和缺陷都视而不见吗?在法律的制定过程中究竟哪些因素影响了立法,进而决定了法律的样貌呢?场域理论提供了一种可能的途径,以《诉讼费用交纳办法》的制定过程为例,回到立法的场景中细致考察这些因素,我们或许能够更清楚地认识和评价立法。

There is a common phenomenon in the legislation, the new law is criticized just after its promulgation, which is worthy of reflections.
