摘要
劳动者的赔偿责任制度对于劳动法体系的完整和立法价值的实现具有重要的意义。为了实现劳动法的倾斜保护功能,应对劳动者的赔偿责任进行限定。在追究劳动者的赔偿责任时,可以移植民事合同的竞合理论,如果用人单位选择合同之诉,则不应允许其在解除合同的同时另行主张损害赔偿;如其选择侵权之诉,则应将劳动者的过错范围限定于故意。
The theory of the liabilities of labourers＇ compensation is important for the system of the labor law. It＇ s logical to limit the liabilities of labourers＇ compensation. The theory of the coincide of liabilities could resolve the problem in the theory of the liabilities of laborers＇ compensation. If the unit starts a suit according to the contract law, it eouldn＇t claim damage compensation. If it start a suit according to the tort law, the labourer must have subjective intent.
