摘要
本文旨在于探求美国外交政策制定中的法理渊源问题,并渴求在法学理论与外交关系这两个不同的研究领域之间构架起一座沟通的"桥梁"。通过对于《联邦宪法》中并未明确记载的外交权力的精神源泉、制宪者们关于该项权力的深刻反思以及在制宪会议中关于外交事务处理的具体设计的回顾与分析,初步展现出这一"隐秘"权力背后关于美国宪政与民主政治之间令人难以捉摸的关系图景。
This essay is intended to discover the issues of jurisprudential origins in American foreign policy establishment and also desired to construct a＂bridge＂between the two distinct research areas which are shared by the two subjects that Jurisprudence and Foreign relationships.So the primary aim of the paper is to emerge the unfathomable view of the relationship among the American constitution and democratic polity that is obscured behind the＂secrete＂power from recounting and analyzing the spiritual resources of U.S.Constitution, the thoughts the lawmakers discussed and the designs they selected about this nation＇s uncertain written diplomatic power.
