夫妻共同债务清偿问题立法缺陷及完善

Legislative Defects and Perfection of Liquidation Problem of the Couple's Common Debt

随着市场经济的迅速发展,婚姻家庭关系中的夫妻债务问题日益突出。分析现行婚姻法对夫妻共同债务清偿问题有关规定的立法缺陷,结合审判实践中出现的问题,提出完善夫妻共同债务清偿问题的立法建议。

With the rapid development of market economy,the debt problem of the couple in the relationship of marital family becomes more and more outstanding.This paper analyzes the legislative defects existing in the related regulations about the liquidation problem of the couple＇s common debt in the Marriage Law.It presents the legislative suggestions to perfect the liquidation problem of the couple＇s common debt in accordance with the problems occurred in the trial practice.
