摘要
现有文献关于空间差异环境专利许可假定厂商位置外生,且只考虑了固定费与提成2种形式.本文考虑了边际成本差异对厂商定位的影响,分析了外部发明人和厂商创新者的两部制最优许可策略.对于外部发明人,通过提成制许可2个厂商是最优的;对于内部发明人,出售专利是最优的,并且都出现空间差异最大化.专利对内部人的激励高于外部人.专利的发明增加社会福利但不增加消费者剩余.
It is assumed that locations of firms are exogenous in the research on patent licensing in spatial competition in present literatures, and only fixed fee or royahy are available. This paper analyses the two-part tariff contract for an outside patentee as well as an inside patentee and considers the effect of cost differentiation on location choice of firms. For an outside patentee, offering pure royalty is optimal for the firms, for an inside patentee, saling patent to its rival is optimal, and maximizing spatial differentiation between firms always appears. The incentive for innovation to an inside patentee is higher than that to an outside patentee. Invention of the patent does not increase customer surplus, but increases social welfare.
