土地承包经营权流转的实证分析与对策——基于《物权法》颁布以来法院判决的梳理与研究

在科学发展观指引下,改革、完善现行土地承包经营权流转机制已经刻不容缓。宏观上,借鉴国资委与国企管理层的运作机制,在现有法律基本构架内,将所有权与经营权分离,村委会与村经济合作社分设,各司其职,改进治理结构,强化监督;微观上,规范"乡里中间层"权力、完善承包土地流转制度、构建多元化纠纷解决机制。通过制度建设,最终实现土地承包经营权合法、有序流转之目的。

Under the guidance of the scientific concept of development, reforming and improving the system of the transferring of the right of operation of land is necessary. Drawing on the operation mechanism of the SAMC, we can divide the ownership and management, separate the village committee and the village economic co-op, so that all parties carry out their duties to improve the governance structure and strengthen the supervision. Besides we can improve the circulation system and build ADR system,and so on. Finally, we can fulfil the purpose of the orderly flow.
