摘要
诉讼调解与人民调解是解决社会矛盾纠纷不可或缺的重要方式。但目前两者的优势没有得到充分发挥,没有很好地衔接,尤其是人民调解制度日渐萎缩。建立人民调解与诉讼调解的对接机制,有利于社会矛盾的迅速化解,有利于缓解法院的工作压力,有利于维护社会稳定。通过建立相对固定的调解组织,建立专门的指导组织,形成制度化的指导机制,建立法院与人民调解的程序性接触机制,将诉讼调解与人民调解对接工作纳入综合治理考核等措施,实现化解社会矛盾纠纷的社会力量与审判力量有机结合。
The lawsuit mediation and people mediation are indispensable to resolve social contradictions and dis- putes. But, at present, both advantages, especially the gradually shrinking of people mediation, can not be brought into full use and connection. The building of the connection system between the lawsuit mediation and people mediation will be beneficial to rapidly resolve social contradictions, relieve the working pressure of court and safeguard so- cial stability. The social forces of resolving social contradictions and the adjudication can be combined associated through some measures, including the establishment of relatively fixed mediation organization and specialized guiding organization, the formation of institutional guiding system, the establishment of connected system between the court and people mediation procedure, the comprehensive treatment of the lawsuit mediation and people mediation.
