摘要
发展低碳经济需要创新的法律制度作为支撑。我国低碳经济的发展需要从碳排放的事前、事中和事后3个方面进行法律规制。碳减排事前规制的目标是发展清洁能源,要求是:调整国家能源规划,科学处理可再生能源与清洁能源的关系;增加财力和智力投入,加强清洁能源的科研和开发;确立清洁能源强制配额制度,为清洁能源的发展拓展空间;改革价格制度,提升清洁能源的竞争能力;改革知识产权制度,激励清洁能源的技术创新。
The development of low-carbon economy requires the support from an innovative legal system. The development of China＇s low-carbon economy should be legally regulated from the three aspects：before carbon emission, during emission and after emission. The aim of the regulation before emission is to develop clean energy, whose requirements are：adjusting national energy planning, scientifically dealing the relationship between renewable energy and clean energy, increasing the financial and intellectual input to strengthen clean energy research and development, building a mandatory clean energy quota system to expand the development of clean energy, reforming the price system to enhance the competitiveness of clean energy, and reforming intellectual property system to encourage clean energy technology innovation.
